Process issued to D-1 not received back. However,
Ld. Counsel for D-1 has appeared, therefore, the proceeding
of issuance of summons again, qua service of D-1 is hereby
dispensed with.
Ld. Counsel for D1 and D7 seeks time to file WS.
Heard. Request allowed in the interest of justice. He is
directed to file WS within stipulated period and an advance
copy of the same be supplied to the opposite party against
proper receipt.
As per report of Ahlmad, D2 to D6 and D8 have been
served on 06.09.2024. However, none has appeared for D-2 to
D6 and D8 despite calls.

At this stage, Ld. counsel for plaintiff submitted that
defendants are in illegal and unlawful possession of suit
property and that they are trying to create third party in
interest in the suit property by alienating or by disposing off
the same. He further submitted that in case the defendants are

not stopped from doing so, the purpose of filing the present
suit would become infructuous.
Submissions heard. Record perused.
Considering the submissions of Ld. counsel for the
parties and also in order to preserve the suit property and to
avoid the multiplicity of litigation, defendants are directed to
maintain status quo w.r.t. suit property admeasuring 480 sq.
yds., Khasra No. 25, situated in Village Ghondli, Delhi,
presently known as Gali no. 7 & 8, Shanti Mohalla, Gandhi
Nagar, Delhi 31, (as shown in colour red in the site plan), till
next date of hearing.
Matter is adjourned.
Matter be listed for further proceedings on
09.01.2025. NDOH is given as per convenience of the Ld.
Counsels for the parties.
