Sh. J. P. Singh, proxy Counsel for Defendant (through
VC).
Proxy Counsel for Defendant submits that grandmother of
briefing counsel Sh. Shivendu Chauhan has expired yesterday. He
further submits that the case file is with the briefing counsel and on this
ground, he seeks an adjournment. Proxy Counsel for Defendant
submits that affidavit of A/D is ready and ensures to file the same
within a week with advance copy to other side.
Be filed within a week.
Matter is listed today for examination of parties under
Order X CPC.
Proxy Counsel for Defendant submits that Defendant is
not available today as his ticket could not be arranged.
Perusal of record shows that last date was 02.05.2025 and
direction was given for appearance of parties for their examination
under Order X CPC. It is for the defendant to make arrangement in
advance for his presence before the court today.
For today’s adjournment, Defendant is burdened with costs
of Rs.10,000/- (half be paid to Plaintiff and half be deposited by him
with DLSA(Shah)).
Both the parties are directed to appear in person on NDOH
for their examination under Order X CPC.
