Counsel for MCD alongwith AE/MCD appeared on service of notice u/o 16 rule 12 CPC. In view of appearance of MCD, notice u/o 16 rule 12 CPC stands discharged. Ld. Counsel for MCD submits that they did not receive any notice because of which they cannot appear. He further submits that they have not received copy of any amended plaint and after receiving the same, they will decide whether any amended WS is to be filed or not. Plaintiff is directed to supply the copy of amended plaint to the defendants. Amended WS, if any, be filed by the defendants with advance copy to the other side. Replication, if any, be filed by the plaintiff with advance copy to the other side. Both the parties are directed to file affidavit of A/D of the documents respectively filed by the other side with advance copy to the opposite party.
