Present: Sh. Abhishek Rana along with Sh. Hemant Kumar, Ld.
Counsels for the plaintiff.
Defendant with Legal Aid Counsel Sh. Pradeep Shukla.
The matter is fixed for filing of the replication and also
for case management. Today, Ld. Counsel for the plaintiff has filed
the replication. Copy thereof has been supplied to the Ld. Counsel
for the defendant.
Since the pleadings of the parties have been completed.
So, from the pleadings of the parties, following issues have been
arisen and are being framed:-
(1) Whether the plaintiff is entitled to recover an
amount of Rs. 6,50,002/- from the defendant? OPP
(2) Whether the plaintiff is also entitle to recover any
interest from the defendant? if so, at what rate?OPD
(3) Whether the plaintiff has concealed the material
facts from the court and the case of the plaintiff is liable to be
dismissed as per provision of Order 7 Rule 11 of CPC? OPD
(4)Relief.
No other issue arises or pressed upon by any of the
counsels for parties.
Both the parties are directed to file list of witnesses in
the court within 15 days from today and to exchange the copies
thereof with the opposite party.

The matter stands adjourned for evidence of the
plaintiff.
Plaintiff is directed to file affidavits of all the witnesses
in the court, one week prior to the next date of hearing and to supply
advance copies thereof to the defendant or her counsel in similar
fashion.
