Present: Sh. Devendra Saran Saxena, Ld. Counsel for DH.
None for the JD.
Perused the report on the warrant of attachment of the movable goods of the
JD. Perusal of report reveals that one lady was there at the given address, but, she did not
disclose her name and only stated that Sangeeta Babbar was not available at the said
address. Ld. Counsel for DH submits that JD Sangeeta Babbar is a defendant in another
matter CS (Comm.) No. 162/22, titled as PNB Vs. Rajesh Babbar & Anr. and the said case
is also listed today in the court of Sh. Sanjay Sharma – II, Ld. District Judge (Commercial
Courts), JD has filed WS in the said case along with statement of truth and in the statement
of truth, the JD has given same address to be her residential address. Clearly, the JD is
avoiding the process of law.
Issue fresh warrant of attachment of movable goods of the JD on filing of
PF, returnable on 09.04.2025.
DH to appear before Ld. ACJ, Shahdara District, Karkardooma Courts,
Delhi on 20.03.2025.
SHO is directed to depute two police officials for the assistance of bailiff at
the time of execution of warant of attachment of the movable goods of the JD and one of
the police official should be a lady. The said police official should enter the premises of the
JD to see as to whether any movable goods of the JD are available at the said address or
not.
Copy of the order be given dasti.
