plaintiffs.
Sh. Jitendra Kumar Ld. Counsel for both defendants.
Ld. Counsel for plaintiffs submits that he has
received the copy of WS filed by defendants and also seeks
time to file replication. Heard. Be filed within four weeks with
advance copy to the opposite party.
An application for waiving of cost filed on behalf of
defendants. Same be taken on record. Copy supplied.
By way of said application, defendants are seeking
waiving of cost imposed vide order dated 07.04.2025 on the
ground that on the scheduled date, Ld. Counsel for defendants
went to Bulandshahar District Court and therefore, could not
file WS. On the other hand, Ld. Counsel for plaintiffs opposed
the said application.
Submissions heard. Record perused.
Though the ground taken by defendants is not wholly
convincing, yet, in the interest of justice, the afforesaid is
disposed of as partly allowed and the cost is reduced to Rs.
2000/- from Rs. 3000/-.
Cost paid to Ld. Counsel for plaintiffs.
Parties are directed to file affidavit of admission-
denial of documents and proposed issues. Advance copy of the
same be exchanged with each other.
Put up for completion of pleadings and framing of
issues on 01.09.2025.
