Accused persons are present on bail.
Sh. Mahesh Chand, Ld. Counsel for all the accused persons.
1. Ld. Counsel for accused has moved an application seeking
cancellation of NBW issued against the accused Shivam Sharma while
submitting that accused failed to appear before the Court on the last date of
hearing since his son was not well; that absence of the applicant/accused
was neither deliberate nor intentional; he further undertakes to appear
before the Court on each and every date of hearing, therefore, lenient view
be taken against the accused/applicant and NBWs issued against him may
be cancelled.
2. Submissions heard. Record perused. Application is not
supported with any medical documents, however, considering the aforesaid
submissions and also in the larger interest of justice, the NBW issued
against the applicant/ accused is cancelled only subject to cost/fine of Rs.
1,000/-. Applicant/accused Shivam Sharma is warned to be careful in
future.
3. Put up for PE on 16.05.2025. PW/complainant Rakesh and
PW Devender be summoned for next date of hearing.
4. Copy of this order be given dasti to Ld. Counsel for accused
persons, as prayed for.
