Today this appeal is fixed for FP/arguments.
However, Ld. Counsels, upon instructions from the
parties, have submitted that there are chances for settlement in
the present appeal and have requested this matter to be referred to
the Mediation Centre.
Accordingly, parties are directed to appear before
Mediation Centre on 03.02.2025 at 12 noon for efforts of
settlement.
Put up this appeal for verification of settlement, if
any/arguments on 22.02.2025.

At this stage, Ld. Counsel for respondent has moved
an application seeking release of the DD, which was placed on
record by appellant, in favour of respondent in compliance of the
order passed by this court dated 06.07.2024.

Submissions heard. Record perused.
The respondent, during the course of submissions,
has undertaken that in case any adverse order is passed against
him in the present appeal, then he shall return the said amount, if
so released by this court, failing which he shall be liable in
accordance with law. Separate statement of respondent has been
recorded in this regard.
In view of the said submissions a well as in the light
of statement/undertaking of respondent, upon due verification,
Ahlmad is directed to release the above said DD for an amount of
Rs.36,000/- drawn on Union Bank Of India, bearing no. 241981
dated 09.09.2024, to the respondent Anshul Gupta against proper
receipt after taking photocopy of the same on record. Further,
Manager of concerned bank is directed to revalidate the said DD
and release the amount in favour of respondent Anshul Gupta.
Application is disposed of accordingly.
