Today, this matter is fixed for verification of payment/
recording of statement of parties/disposal of pending appeal.
It is submitted by respondent, who is present through
VC, that he has already received the full an final settlement amount
of Rs.90,000/- from the appellant.
It is submitted by Ld. Counsel for appellant that
appellant has already paid the full and final settlement amount to
respondent, therefore, it has been prayed that present appeal may
be disposed of in accordance with law. Statement of Ld. Counsel
for appellant has been recorded to the said effect.
Since the present matter has been settled between the
parties before mediation centre vide settlement dated 10.02.2025,
therefore, vide separate judgment of even date, the offence under
Section 138 N.I. Act stands compounded between the parties and
consequently, Sh. Anand Sharma, proprietor of appellant firm,
stands acquitted. As nothing remains to be adjudicated in the
present criminal appeal, therefore, same is disposed of. Bail
bond/surety bond stands cancelled/discharged.
