WS with affidavit and reply to application u/o 39 rule 1 & 2 r/w
section 151 CPC with affidavit as per list alongwith documents (running upto
68 pages) with fresh vakalatnama filed on behalf of defendant no. 1. Counsel
for the defendant no. 1 submits that copy of the same was supplied through
speed post on the address of the plaintiff.
Counsel for the plaintiff submits that she has not received the
copy of the same. She further submits that plaintiff is unwell and therefore, the
plaintiff could not come to court today.
Counsel for defendant no. 1 submits that in order to avoid
controversy, he will supply the copy of the above on the whatsapp number of
plaintiff during the course of the day. Numbers exchanged.
Counsel for defendant no. 2 submits that he has not received
complete paper book and only copy of the plaint has been received. Ld.
Counsel submits that complete paper book may be supplied to him on his
Whatsapp number. Counsel for the defendant no. 2 requests that copy of WS
filed by defendant no. 1 may also be supplied to him.
Counsel for the plaintiff and defendant no. 1 ensures to supply
complete paper book of plaint and copy of WS respectively at the whatsapp

number of defendant no. 2. Thereafter, defendant no. 2 shall file WS within 04
weeks with advance copy to the other side.
Replication, if any, be filed by the plaintiff within 04 weeks with
advance copy to the other side.
List for completion of pleadings, A/D of documents and framing
of issues on 03.01.2025. A/D of documents be filed by the parties in form of
affidavit.
