Sh. Gaurav Tripathi, Ld. Proxy Counsel for the JD.
Ld. Proxy counsel for the JD seeks some time due to
personal difficulty of main counsel.
Perusal of record shows that the present execution
has been filed by the DH against the order dated 03.04.2024
passed by this Court whereby the application of DH under Order
12 Rule 6 CPC was allowed against the JD on the basis of the
admissions of the JD in the instant suit in his WS, thereby
directing the JD to handover vacant and peaceful possession of
the suit property to the DH.
Admittedly, JD has not challenged the order dated
03.04.2024 passed by this Court, nor any objections has been
filed on behalf of JD till date.
In view of the above, issue warrants of possession of
suit property no. C-7/G-B, ground floor, upto ceiling level LIG
flat, meas. 45 sq. yards out of Khasra no. 1076/5/2/390, Village
Jhilmil, Tahirpur, Dilshad Colony, Delhi-95 on filing PF/RC
returnable for NDOH.
Bailiff is directed to break open the locks if the
premises are found locked.
At request of DH, the concerned SHO of PS
Seemapuri is also directed to give police aid to bailiff/DH in
execution of warrants of possession.
Steps be taken within 07 day from today.

Put up before Ld. ACJ, Shahdara for appointment of
bailiff on 20.12.2024 and before this Court for report of bailiff
on 21.02.2025.
