Counsel for appellants along with appellant No.
2 Ankit Aggarwal.
None for respondent.
The appeal has been filed on behalf of company i.e.
M/s Perfect Wellness Pvt. Ltd, represented by its Director Ankit
Aggarwal and also Ankit Aggarwal in personal capacity.
The appellant has challenged the judgment dt.
31.01.2024 and order on sentence dt. 24.05.2024 vide which he
was convicted and sentenced to pay fine of Rs. 31,35,032/-
within a period of 30 days from the order on sentence in default
to undergo SI for a period of 30 days. It is submitted that the
amount has not been paid and the appellant will contest the
judgment/order on sentence on merits.
Ld. Counsel for appellant has filed an application
u/s 389 (1) Cr.PC for suspension of sentence and for grant of
bail. It is submitted that disposal of appeal shall take time and
during the pendency of case before the Ld. Trial Court, the
appellant was on bail and he has good chance to succeed in the
present appeal.

Considering the above, an application u/s 389 (1)
Cr.PC filed for suspension of sentence of appellants M/s
Perfect Wellness Pvt. Ltd and Ankit Aggarwal is allowed and
Convict/appellant Ankit Aggarwal is admitted to bail on his
furnishing personal bond in the sum of Rs. 50,000/- with one
surety of like amount till the pendency of appeal subject to
the condition that:-
1. That the appellant will appear regularly during the
hearing of appeal.
2. That the appellant shall not leave the country without
the permission of the court.
3. That the appellant shall not seek any adjournment
without any sufficient cause.
Issue notice to respondent on filing PF/RC/Speed
Post and through e-mail mode/whatsapp. Steps be taken
within a week.
TCR be called from the concerned Trial Court on
the next date.
Put up for consideration on 26.07.2024.
Copy of this order be given dasti to Ld. counsel
for appellant.
