Brief facts of the case are that on 01.02.2020 at about 02:00 am when complainant Shadab Alam Khan reached at NSA Colony in front of Community Bhawan, near Bhikam Singh Colony, Delhi, three unknown boys of aged about 2530 years came there on a yellow colour motorcycle and shown him knife and robbed one mobile phone make Redmi containing sim of Jio and purse containing voter ICard, ATM Card of PNB, PAN Card and Rs.200/ to Rs.300/ of complainant. Accused Prahlad was arrested at the identification and instance of complainant. He disclosed that he had sold the mobile Contd…./ -- 1 of 2 -- [ 2 ] phone to Sharik. During the course of investigation, accused Sharik was found in possession of mobile phone make Redmi of complainant being the stolen property. After completion of the investigation, chargesheet in the present case is filed. Primafacie case for the offences under Section 392/397/34 IPC is made out against accused namely Prahlad and Section 411 IPC is made out against accused Sharik. Accordingly, charge has been framed against accused persons namely Prahlad and Sarik, to which they pleaded not guilty and claimed trial. Now to come up for PE on 02.01.2024.
