1. Perusal of the record reveals that today, the matter is
fixed for PE. However, no PW is present today.
2. Perusal of the report on summon sent to PWs-Ct. Yashvir
and ASI Rajbir reveal that they could not appear today since they both
are on casual leave.
IO/SI Nitin is absent despite service. No adverse order is
being passed against him in the larger interest of justice.
3. At this stage, Ld. Counsel for the accused Shariq
submitted that accused Shariq was the bonafie purchaser of the mobile
phone which has allegedly been robbed by co-accused Prahlad @
Gaurav; that accused Shariq has been charged only for the offence
punishable under Section 411 IPC.
It is further submitted that the accused Shariq wants to
compensate the victim and wants to compound the present matter.
Therefore, an application under Section 320 Cr.P.C for compounding
of the present matter has been moved today on behalf of accused
Shariq.
4. Submissions heard. Record perused.

5. Let a notice of this application be issued to the
complainant/victim for the NDOH.
6. Put up for PE on 11.12.2024. PWs Ct. Yashvir, ASI
Rajbir and IO/SI Nitin be summoned afresh for the NDOH.
