Fresh suit received by way of assignment. It be checked and reg
istered.
Present: Sh. Sushant Chanchal, Ld. Counsel for the Plaintiff
with Plaintiff.
This is a suit recovery of Rs. 5 lacs filed by the plaintiff
against the defendant on the ground that plaintiff has purchased
one mini Truck from defendant no.2 at the introduction of
defendant no.1.
Ld. Counsel for the plaintiff submits that after purchasing
the said mini Truck from defendant no.2, the same got stolen and
since the ownership papers/RC of the said Truck was not
transferred in the name of the plaintiff at that time, therefore, the
insurance company had indemnified the entire amount to
defendant no.2 and not to the p laintiff and since then the plaintiff
has been requesting the defendant no.2 to return the said amount,
however, the defendant no.2 has not paid any heed to the request
of the plaintiff.
At this stage, plaintiff has no objection if the defendant
no.1 is deleted from the array of parties.
In view of the same, the defendant no.1 is hereby deleted
from the array of parties.
Plaintiff is directed to file amended memo of parties in
this regard.
I have perused the plaint along with documents.
On filing of the amended memo of parties, issue summons
of the plaint along with documents upon the defendants, through

all modes, including speed post/Registered AD, on filing PF/RC.
Steps be taken within 07 days.
Put up for service of defendant/further proceedings on
11.09.2024.
