PW-1/AR Sh. Ravi Kant Sharma.
Defendant No.1 and 2 in person in Court.
Sh. Yashpal Singh along with Sh. Umang Verma and
Sh. Himanshu Baliyan, Ld. Counsels for defendant no. 3.
Original documents were filed by the plaintiff Bank on the last
date of hearing.
Ld. counsel for defendant No.3 has requested to reduce the cost
imposed on the last date of hearing. At request, the cost is reduced to
Rs.2,000/-. Cost of Rs.2,000/- paid.
As far as defendant no.3 is concerned, counsel for defendant
no.3 submits that the present case is not a commercial dispute. He may
address this issue at the stage of final arguments. But at the stage of evidence,
the matter must proceed further and the defendants should cross-examine the
witness.
PW-1 cross-examined and discharged.
Ld. Counsel for plaintiff submits that he does not want to
examine any other witness. Separate statement of plaintiff/PW1 to this effect
recorded. In view of statement made, PE stands closed.
