Present : Plaintiff in person with Counsel Sh. Vikram Baweja,
Advocate.
Defendant in person with Counsel Sh. Jatin Malhotra,
Advocate.
Written statement, along with statement of truth and
affidavit of admission or denial of the documents has been filed on
behalf of the defendant in the Court today. Copy of the same be
supplied to the Ld. Counsel for the plaintiff, within a period of three
days from today by registered post and electronic modes.
It is reported by the Ld. Counsels for the parties that the
matter stands amicably settled between the parties, qua the claim of
the plaintiff, regarding the possession of the tenanted premises. It is
also prayed that the dispute regarding the remaining relief/claims of
the plaintiff, pertaining to the arrears of rent and mense profits/
occupational charges may be referred for mediation.
Statement of the plaintiff and the defendant are recorded
separately in this regard.
In view of the amicable settlement between the parties,
regarding the relief of possession of the tenannted premises and in
view of their statements recorded in the Court today, the suit of the
plaintiff regarding his relief for possession of the suit property i.e. C-
CS (COMM) 284/24 page 1 of 2 DJ (Comm.)-01/Shahdara/KKD/Delhi

4/6, Block-C, Plot No. 6, Krishna Nagar, Delhi – 110 051, is hereby
disposed off as settled/compromised.
A compromise decree, regarding the possession of the
aforesaid tenanted property be drawn accordingly. The statements of
the parties, recorded in the court today, along with the site plaint Ex.
D-1 and the Lease Deed Ex. D-2, shall form the part & parcel of the
compromise decree. It is ordered accordingly.
From the submissions of the Ld. Counsels for the parties
and their statements recorded in the Court today, it appears that there
is an element of settlement between the parties. Therefore, the matter
is referred for mediation. Parties and their Ld. Counsels are directed to
appear before the Ld. Judge Incharge, Mediation Centre,
Karkardooma Courts, for mediation, on 08.07.2024 and to report
before this Court, on the next date of hearing.
Adjourned for recording of settlement, if any, and for
completion of pleadings and first case management hearing, on
06.08.2024.
