Present: Sh. Abhishek Garg, ld. Counsel for plaintiff with plaintiff.
Ms. Manvika Maggo, ld. Counsel for all defendants with
defendant no. 1.
In between, defendant has filed WS alongwith condonation of
delay application alongwith documents (as per list) and vakalatnama. Copy
supplied.
Counsel for defendant submits that there is a delay of 37 days in
filing of WS as the documents were not available with the defendants and they
had to collect the same from their native place.
Ld. Counsel for the plaintiff submits that he has no objection if
the application seeking condonation of delay in filing WS is allowed subject
to cost.
Heard.
For reasons stated in the application and also in view of no
objection given by counsel for the plaintiff, present application is allowed.
Delay in filing WS is condoned subject to cost of Rs.1,000/- to be paid by
defendants to the plaintiff.
Application u/o 8 rule 1 CPC stands disposed off.
Ld. Counsel for the plaintiff submits that few documents filed
alongwith WS are not legible. He seeks some time to inspect the file and
thereafter, file the replication to the WS filed by the defendant. Be filed within
04 weeks with advance copy to the other side.

of issues on 19.12.2024. A/D of documents be filed by the parties in form of
affidavit.
