Present : Sh. Abhishek Garg, Ld. Counsel for Plaintiff with son of
Plaintiff.
Sh. Harshit Verma, proxy Counsel for Defendant no. 1 and
2.
Ahlmad to tag the Amended Memo of parties and amended
plaint at the correct place in the file today itself.
Ld. Counsel for Plaintiff points out that in the verification
clause of the written statement, bears the signature of Defendant no. 1
only. Ld. counsel further submits that affidavit along with Written
statement should be filed by D-1. Ld. counsel thus submits that Written
statement can be considered only for Defendant no. 1.
Proxy Counsel for Defendant submits that main counsel is
not available today and seeks time to make submissions.
Perusal of written statement shows that same is duly
signed by D-1 and D-2; and is also accompanied by the supporting
affidavits of D-1 and D-2.
In between, affidavit filed by Defendant no. 1 regarding
A/D of documents of plaintiff. Copy supplied.
Ld. counsel for parties submit that issues may be framed.

On the basis of pleadings of parties, the following issues
are framed:-
1. Whether the present suit suffers with non-joinder/mis-joinder of
the necessary parties?OPDs
2. Whether the suit is barred by Limitation?OPDs
3. Whether the Plaintiff has concealed the material facts?OPDs
4. Whether the Plaintiff is entitled for decree for recovery of
Rs.15,43,000/- from the Defendants? OPP
5. Whether the Plaintiff is entitled for Interest? If so, at what rate
and for which period? OPP
6. Relief
No other issue arises or pressed for.
List of witnesses be filed by both sides within 14 days. Let
evidence affidavits of all the PWs be filed on record within 04 weeks
and advance copy of same be supplied to the other side at least 10 days
prior to next date.
