File perused.
Plaintiff by way of amendment wants to amend the
para no.5, 6, 25, 26 and 27 of the plaint. By way of proposed
amendment the plaintiff wants to add some factual facts as well
as want to insert the jurisdiction and cause of action paragraph.
In view of the contentions made in the application,
submissions given by the Ld. counsel for the plaintiff,
considering the fact that present suit is still at initial stage,
defendant is yet to be summoned in the present suit and proposed
amendment shall not change the nature of suit, the application
under Order VI Rule 17 r/w Section 151 CPC is stand allowed.

CPC is accordingly disposed off.
Amended plaint was already filed by the plaintiff.
Same is taken on record.

Issue summons in the present suit as well as notice
of the application under Order XXXIX Rule 1 and 2 CPC upon
defendant on filing of PF/RC/Courier, returnable for the NDOH.
PF be filed within 07 days from today.
Put up for compliance, appearance of the defendantt
and further proceedings on 08.10.2024.
