WS already filed on behalf of R1 and R2. Copy supplied
to the petitioner.
WS also filed on behalf of R3. Copy supplied to the
opposite parties.
Petitioner is directed to file the certified copies of the
crimical case record by the NDOH positively.
Pleadings of the parties are complete on record.
On the basis of pleadings of the parties, following issues are
hereby framed as under:
(i) Whether deceased died on account of injuries
sustained in accident having taken place on 10.11.2023 at about 02:04
pm near Udaygarhi Gate on the Somna Khaira Road, within the
jurisdiction of PS Khair Distt. Aligarh, U.P. due to rash and negligent
driving of driver of vehicle no. HR38AC-3651 by respondent no. 1?

(ii) Whether petitioner is entitled to compensation, if so
to what amount and from whom? OPP.
(iii) Relief.
Be put up for PE on 07.02.2025.
Petitioner is hereby directed to furnish advance copy of
evidence by way of affidavit of the proposed witnesses to the

respondents atleast 15 days prior to the NDOH either against receipt or
by placing the same on judicial file under intimation to the respondents
to be collected by the parties as per their respective convenience.
