Present:- Applicant/ petitioner no.2 Ram Roop with counsel.
Heard on the application under section 151 CPC, moved on behalf
of the applicant/ petitioner no.2 Ram Roop for release of his share in award
amount, which is lying deposited in the form of an FDR for the period till he
attains the age of majority.
It is stated that the appeal preferred by R2/ UPSRTC challenging
the award dated 05.06.2018, passed by learned predecessor of this Tribunal, has
been dismissed vide order dated 30.11.2023 of Hon’ble High Court with the
direction that award amount be released to the petitioners in terms of original
award.
I have perused the award dated 05.06.2018. As per para no.16.2 of
the award, share of petitioner no.2, amounting to Rs.1,53,600/- with
corresponding interest was kept secured in the form of an FDR for the period till
he attains the age of majority. As per Aadhaar Card of the applicant which
reflects his date of birth as 01.01.2021, it is clear that the applicant has turned
major now.
In view of above, Manager, UCO Bank, Karkardooma is directed to
release the entire amount of the FDR of applicant along with the accrued interest
by way of transferring the said amount into his MACT Bank Account.
Application is disposed of.
This miscellaneous file be tagged with the main case file and be
consigned to Record Room.
