Sh. Rajesh Kumar Sharma Ld. Counsel for JD with JD.
Bailiff has filed his report, as per which, warrant of
possession was executed on 19.12.2024 and DH has received the
possession of suit property.
At this stage, Ld. Counsel for DH submits that since he has
already got the possession of the suit property, therefore, he does not
wish to pursue the present matter and prays for disposal of the same
as satisfied. Heard.
On the other hand, Ld. Counsel for JD has filed an
application u/o 21 R 106 CPC for setting aside impugned order dated
06.12.2024 a/w documents. Same be taken on record. Copy supplied.
Ld. Counsel for DH seeks time to file reply to the aforesaid
application. Heard. Be filed on or before NDOH through proper
channel with advance copy to the opposite party, against proper
receipt.
At this stage, Ld. Counsel for DH has also filed the copy of
order dated 04.11.2024 passed by the Hon’ble Delhi High Court,
wherein it is stated the there is no stay and matter is pending for
17.03.2025.
Matter be listed for reply and arguments on aforesaid
application on 28.03.2025.
