None for JD.
Today, matter is listed for arguments on application under
order 21 rule 106 CPC filed by JD.
On LDOH, last opportunity was granted to JD to address
arguments on aforesaid application with direction that in case of
non-compliance, matter shall proceed in accordance with law.
Perusal of record shows that none is appearing for JD since
17.04.2026. Even today none has appeared for JD despite calls. It
seems that JD does not wish to pursue the aforesaid application. In
view of continuous non-appearance, the aforesaid application is
dismissed for non-prosecution.
At this stage, Ld. Counsel for DH upon instructions submits
that DH has already taken the possession of the suit property on
19.12.2024 and now nothing survives against the JD in present
execution petition and therefore, request to withdraw the present
petition being satisfied. Heard.
Separate statement of Ld. Counsel for DH has been
recorded in this regard.
In view of the statement of Ld. Counsel for DH, present
execution petition is disposed of as withdrawn being ‘satisfied’.
File be consigned to Record Room as per rules.
