Ld. Counsel for Plaintiff submits that Defendants no. 2 and
3 are the same person, therefore, he has filed the present application
under Order 1 Rule 10 CPC for deletion of name of Defendant no. 2/Sh.
Shivam.
Ld. Counsel for Defendant no.3 submits that he has already
mentioned this fact in the preliminary objection and his client is only
known as ‘Sh.Krishna’.
I have perused the record.
Defendant no. 2 and 3 being the same person. Application
under Order 1 Rule 10 CPC is disposed off as allowed. Name of
Defendant no. 2 is hereby deleted from the Memo of parties. Amended
memo of parties is taken on record.
Ahlmad is directed to correct the case title on the CIS
server as ‘Kusum v. Sunita Devi @ Radha and Anr’.
All the parties are directed to file affidavit regarding A/D of
documents.
