Sh. Anuj Tomar, ld. Counsel for defendant no. 1 and 3.
As per the process server report, defendant no. 1 and 3 was served
on 20.05.2024.
Counsel for defendant no. 1 and 3 submits that WS is ready and
he is filing the same alongwith condonation of delay application during the
course of the day. Copy supplied. He further submits that the plaintiff has not
supplied the entire set of paper book to him. He further submits that he has
only received plaint, cheque and return memo. Counsel for plaintiff ensures to
supply the rest of the documents to the counsel for defendant no. 1 and 3 on
his Whatsapp number and on Email ID mentioned on the copy of WS.
As per the process server report, defendant no. 2 remains
unserved with a report that “no such person resides at the given address”.
Subject to filing of fresh address of defendant no. 2, issue fresh
summons to defendant no. 2 on filing of PF/RC/SP, returnable for NDOH.
Plaintiff to take necessary steps in this regard.
Put up for service report of defendant no. 2 and further
proceedings on 14.10.2024.
