Present : Plaintiff no. 2 with Sh. Prabhakar Narayan Ld.
counsel for plaintiffs through VC.
Sh. Ashish Agarwal Ld. Counsel for defendants.
Today, matter is listed for further arguments on applications
under section 151 CPC.
At this stage, Ld. Counsel for defendants submits that there
another connected matter i.e. CS No. 283/21 titled as ‘Sanjay Tyagi
vs. Manish Kumar & Anr.’ is also listed for today. He further submits
that during the pendency of the present suit, he had filed an
application dated 28.03.2025 under section 151 CPC for clubbing of
present suit and CS No. 283/21. However, inadvertently, the said
application was taken up in present suit and part arguments were
heard. He further submits that prior to lead PE in this matter, the
disposal of the said application is necessary and therefore, request that
said application may kindly be disposed of first. On the other hand,
Ld. Counsel for defendants vehemently opposed the said submissions
and submits that delaying tactics are being adopted by plaintiffs.
Heard. On perusal of record, submissions find placed.
In view of above submission, Ahlmad is directed to place the
aforesaid application in CS No. 283/21 by NDOH.
Matter be listed for further proceedings on 22.08.2026.
NDOH is given as per convenience of Ld. Counsels for the parties.
