Present : Sh. Mukesh Sachdeva Ld. Counsel for plaintiff.
D-1 in person. He is also appearing for D-2 being her
husband.
At this stage, D-1 submits that on LDOH, he had already
received the copy of plaint a/w documents, however, WS could
not be prepared as he was not in contact with his counsel and due
to the said reason, WS could not be filed within stipulated period.
Perusal of record shows that on LDOH i.e. on
10.07.2024, D-1 took the plea that he had received the copy of
plaint without the copy of documents and due to the said reason
WS could not be prepared. Subsequently, Ld. Counsel for plaintiff
was directed to supply the same during the course of the day.
At this stage, Ld. Counsel for plaintiff submits that he has
already supplied the complete paper-book to D-1 against the
acknowledgment, but D-1 is deliberately and intentionally
delaying the matter.
Submissions heard. Record perused.
Perusal of record shows that since 10.07.2024, no WS
has been filed on behalf of the defendants within stipulated period
nor there is any application seeking condonation of delay on
behalf of defendants. Therefore, in view of the aforesaid facts and
circumstances, right to file WS by defendants is hereby closed.
Matter is adjourned.
Matter be listed for PE on 10.12.2024. NDOH is given as
per convenience of the Ld. Counsel for plaintiff and the parties.
