Sh. Tushar Tokas, Advocate filed his Vakalatnama on
behalf of defendant no.1 to 4. It be taken on record.
Sh. Vipin Kumar, ld. Counsel for defendant no.5.
Process in respect of defendant no.1 not yet received back.
At this stage, ld. Counsel for defendant no.1 to 4 submits
that he has been engaged today itself on behalf of defendant
no.1 to 4 and seeks time to file written statement. Heard.
Record perused. A perusal of record reveals that service of
summons upon the defendant no.2, 3 and 4 has been
effected on 31.07.2023, 26.07.2023 & 01.08.2023
respectively, despite that no steps has been taken by the
defendant no.2, 3 and 4 to file written statement. The
period of limitation to file written statement by defendant
no.1 to 4 has already been expired. Therefore, opportunity
of filing written statement on behalf of defendant no.2, 3 &
4 is hereby closed.
Since Ld. counsel for defendant no.1 has filed Vakalatnama
on behalf of defendant no.1 today itself, hence service upon
defendant no.1 is deemed to be served today only.
Ld. counsel for defendant no.1 is directed to file WS within
30 working days from today with advance copy to opposite
party.

At this stage, ld. Counsel for plaintiff submits that he has
already filed replication to WS of defendant no.5 on
21.10.2023. Heard.
Record perused. Replication to WS of defendant no.5 finds
placed. It be taken on record.
