Today, this matter is listed for arguments on appeal as well as
applications u/o 151 CPC and u/o 7 rule 14 CPC.
On the last date of hearing, the parties were directed to file
written arguments qua the aforesaid applications.
At this stage, Ld. Proxy counsel for appellant submits that main
counsel is not available today as he is busy in taking care of his mother who
is suffering from Cancer and requests for short adjournment.
Heard. Request is allowed. In the interest of justice, one last and
final aportunity is granted to Ld. Counsel for appellant to argue the aforesaid
appeal and application, failing which, heavy cost will be imposed on the
NDOH.
Parties are again directed to file written arguments, confining to
2-3 pages only, on or before next date of hearing with the direction to supply
advance copy of the same to each other.
At request, matter is adjourned.
