IO/SI Shiv Dayal Kumar is present upon execution
of BWs. He is directed to remain cautious in future.
Otherwise, this matter is fixed for PE today.
PW-1 Karan Singh is examined partly and his
further examination-in-chief is deferred for want of FSL analysis
report as well as for want of case property i.e. motorcycle. PW-1
Karan Singh be summoned later on.
It is pertinent to mention that MHC(M) has neither
produced the case property i.e. motorcycle nor has intimated this
court before leaving the court room, while the evidence of PW-1
was being recorded, which ultimately had to be deferred for want
of case property.
Accordingly, issue notice to MHC(M) as well as
SHO concerned to appear before this court and render
explanation in this regard, failing which, an appropriate order in
accordance with law shall be passed.

Further, IO/SHO is directed to follow up with the
FSL concerned regarding the aforesaid result of case property
and file the requisite report on NDOH.
Director FSL, Rohini is directed to expedite the
result of the case property. Priority letter be issued in this regard
through DCP concerned.
ASI Anil Kumar is present upon execution of BWs.
He is directed to remain cautious in future. He is examined as
PW-2 and discharged.
PW HC Furkan Ali not present despite service.
However, a written intimation has been sent on his
behalf mentioning the reason of his absence. In view of the
same, exemption is allowed for today only. Let he be summoned
afresh for NDOH.
Put up this matter for aforsaid purpose / further PE
on 13.08.2024. PWs mentioned at Sr. No. 2, 3 & 4 in LOW be
summoned for NDOH.
Issue notice to IO to appear in person before this
court on NDOH.
