FIR No. 698/2023
PS Harsh Vihar
U/s 307/34 IPC.
State vs. Rajan Chaudhary and ors.
(Applicant/accused Vikas Bhadoriya)
22.08.2026
ORDER ON THE REGULAR BAIL APPLICATION OF
APPLICANT/ACCUSED VIKAS BHADORIYA.
Present: Sh. Parmod Kumar, Ld. Addl. PP for State.
Sh. A S Juneja, Ld. Counsel for applicant/accused.
1. This is the bail application u/s 483 BNSS filed on behalf of
applicant Vikas Bhadoriya seeking to grant him regular bail, in FIR No.
698/2023 P.S. Harsh Vihar registered under Section 307/34 IPC. Applicant
is in JC since 28.02.2024.
The present matter is pending before this court at the stage of
prosecution evidence.
2. The case of the prosecution is that on 24.12.2023, applicant
along with two other co-accused persons namely Akash Danny and Rajan
Chaudhary, in furtherance of their common intention, fired at the
complainant Karan Singh but the latter managed to save himself. The
specific role of applicant in the crime is that he aimed the pistol at
complainant Karan Singh but could not succeed in firing since he was
caught hold from behind by the complainant’s brother Surender Singh due
to which the pistol fell down on the spot from his hand, however, co-
accused Akash fired at the complainant. Thereafter, applicant along with

co-accused Akash @ Danny fled away from the spot, but accused Rajan
Chaudhary was apprehended at the spot. Later on, applicant was arrested on
28.02.2024.
3. Ld. counsel for applicant submits that applicant has been
falsely implicated in this case; key witnesses of the prosecution have
already been examined; no recovery was effected from the applicant; PW
Ravi has not supported the case of the prosecution; vide order dated
02.05.2025, the Hon’ble Delhi High Court admitted the applicant/accused
on interim bail which was not misused by him and after expiry of the same,
he timely surrendered in jail; he is in JC for more than two years; recently
vide order dt. 13.08.2026, the Hon’ble High Court admitted the co-accused
Akash Danny on bail, who has been assigned the almost similar role int eh
alleged crime as ascribed to the applicant/accused, hence, it is argued that
the ground of parity also, applicant deserves to be admitted on bail.
4. Ld. Addl. PP has opposed this application aruged that
allegations against the applicant/accused are serious; complainant Karan
Singh (PW1), his brothers namely Mangal Singh (PW3) and Surender
Singh (PW5), all eye witnesses to the incident, have supported the
prosecution case and specifically named and identified the applicant during
their respective evidence. He also submits that pistol was recovered from
the possession of the applicant. Applicant is argued to be involved in one
other case of similar nature.
5. Arguments considered.
6. Considering that all the material witnesses have been
examined and on parity as co-accused Akash @ Danny assigned similar
role in the crime has been admitted on bail by the Hon’ble Delhi High
Court. In the totality of facts and circumstances, the present bail application
is allowed. The applicant Vikas Bhadoriya is admitted on regular bail on his
