Summons issued to IO/SI Shiv Dayal Kumar
received with the report that he is on medical rest vide DD
No.38A dated 08.10.2024. Let he be summoned afresh for
NDOH.
Otherwise, this matter is fixed for PE today.
PW-3 Mangal Singh is examined partly and his
further examination-in-chief is deferred as supplementary charge
sheet along with FSL result qua weapon of offence i.e. desi katta
is yet to be filed before this court.
One status report has been sent by SI Shiv Dayal
wherein it has been mentioned that after obtaining sanction u/s
39 A. Act, supplementary charge sheet will be filed qua FSL
result.
In view of above, IO is directed to file the
supplementary charge sheet as per law at the earliest.

PW-3 Mangal Singh be summoned afresh for
NDOH.
PW Karan Singh is present, however, he is
discharged unexamined for today due to paucity of time. Let he
be summoned afresh for NDOH.
Put up this matter for further PE on 10.12.2024.
At this stage, Ld. Counsel for accused Akash @
Yatesh @ Danny has submitted that he does not wish to pursue
bail application of accused Akash @ Yatesh @ Danny at this
stage and seeks liberty to file it later on at an appropriate stage.
Accordingly, in view of the above, the present bail
application is dismissed as withdrawn with liberty as sought.
