Present : Sh. Yogender Singh, Ld. Additional P.P. (Substitute) for
State.
Both accused are absent.
Sh. F. Khan, Ld. Counsel for both the accused persons.
Ld. Defence Counsel has moved an application for exemption of
both the accused persons and has submitted that he will not dispute the identity
of accused persons and will cross-examine the witnesses present today. In view
of the same, exemption application of both the accused is allowed for today
only.
PW-8 Retired SI Devender is examined, cross-examined and
discharged.
Statement of admission/denial of documents by Sh. F. Khan, Ld.
Counsel for accused Intjar @ Hasan and Akil @ Nadeem under Section 294
Cr.P.C./330 of BNSS has been recorded separately. Accordingly, PW/Ahlmad
present from the Court of Sh. Priyank, Ld. MM is dropped from the list of
witnesses.
Summons sent to PW Dr. Abbas Ali and Dr. Narendra received
back unserved. Considering the same, Medical Superintendent of LBS
Hospital is directed to depute some other contemporary doctor(s), who had
worked with abovesaid doctors and can identify and prove their signatures and
handwriting and can depose on their behalf.
No other witness is present except IO/SI Nipender Kumar, who is
discharged unexamined today on the request of Ld. Additional P.P. for the
State.
