Plaintiff with PW-1 Sh. Manish Jaiswal.
Sh. Dinesh kumar Bhati, Ld. Counsel for Defendant
(through VC).
Matter is listed today for PE.
Ld. Counsel for Plaintiff submits that issues were framed
in July 2024, thereafter, Defendant on one pretext or the other has
delayed the matter. He further submits that evidence affidavit of PW-1
Sh. Manish Jaiswal is already on record.
Ld. Counsel for Defendant submits that he is having the
copy of evidence affidavit of PW-1. Ld. Counsel submits that he is
unwell and hence, he has not appeared physically in court.
Last and final opportunity is granted to the Defendant to
pursue the matter diligently and to cross examine PW-1 on NDOH. In
case of non availability of the main counsel, Defendant shall have to
make an alternative arrangement and no further opportunity shall be
granted to him.
PW-1 Sh. Manish Jaiswal is present today. Ld. Counsel for
Plaintiff seeks an adjournment to lead evidence.
