File is taken up on an application seeking cancellation of
NBW issued against the applicant/accused Rashid.
Present: Sh. S.K. Dubey, Ld. Addl. PP for the State.
Applicant/accused has appeared in person.
1. The applicant/accused has submitted that he could not
appear before the Court on the last date of hearing since, he was unwell,
therefore, due to his absence on the last date of hearing, NBW was issued
against him alongwith notice to his surety in order to secure his presence
for the next date of hearing; that his absence on the last date of hearing
was neither deliberate nor intentional but solely due to his illness, he has
annexed his medical documents alongwith the present application. He
has requested that NBW issued against him may be cancelled.
2. Submissions heard. Record perused. Considering the
aforesaid submissions and in the interest of justice, NBW issued against
applicant/accused Rashid is hereby, cancelled. The applicant/accused is
directed to be careful in future. Necessary robekar be issued to the
applicant/accused.
3. The application stands disposed of.
4. Put up the file on the date already fixed i.e. on 24.04.2026.
