Today, the case is fixed for final arguments.
Submissions in this case were heard at length. During the
course of hearing it is found that even though application under Order 6
Rule 17 CPC was partially allowed by this Court on 04.12.2023. The fresh
amended plaint as per amendment allowed has not been filed on record till
date. Also the deficient court fees has not been filed till date.
Passover sought.
As prayed, put up at 2 PM.

Deficient Court fees of Rs.7500/- is placed on record. The
amended plaint alongwith affidavit is sought to be placed on record but it is
found that this is prepared for filing before the Court of Additional District
Judge instead of District Judge (Comm.). The same cannot be accepted and
is accordingly rejected.
Plaintiff seeks time to do the needful. The same is allowed
subject to cost of Rs.25,000/- half of which i.e. Rs.12,500/- to be paid to

defendant and Rs.12,500/- to be deposited with Shahdara Bar
Association within three working days.
Put up for further proceedings on 01.02.2024.
Next date of hearing is given as per convenience of both the
parties.
