Present: Sh. Vijay Arora, Ld. Counsel for plaintiff.
D-1 and D-2 are yet to be served.
D-3 in person.
Process was issued upon the defendants. Report
filed. As per report, D-3 has been duly served. As per report, the
door of the house of D-1 and D-2 found is locked. It is also
mentioned in the report that D-1 and D-2 have left the given
address before two months back.
Plaintiff is directed to file fresh and correct address
of D-1 and D-2.
Upon furnishing fresh and correct address of D-1
and D-2, issue fresh summons in the present suit and notice of
the application under Order XXXIX Rule 1 and 2 CPC upon
D-1 and D-2 on filing of PF/RC/Courier, returnable for the
NDOH.
In case of refusal/non-availability/lock, service be
affected by affixation. Photographs be also taken and filed on
record.
D-3 is directed to file WS and affidavit of admission
and denial of documents within 30 days from today with an
advance copy to plaintiff.

Plaintiff is at liberty to file replication, if any and
affidavit of admission and denial of documents, if required
thereafter within 15 days with an advance copy to D-3.
Plaintiff and D-3 are directed to produce original
documents and file proposed issues on or before the NDOH.
Put up for compliance, completion of pleadings &
admission and denial of documents on 18.07.2024.
