Present: Sh. Vijay Arora, SPA of plaintiff in person.
Ms. Kanika Madan, Ld. counsel for D-1 and D-2
along with D-1 in person.
None for D-3 (right to file WS has been closed and
proceeded ex-parte vide order dated 11.11.2024.).
As per the report of the mediation, the present case
has been settled between the parties vide mediation order dated
13.05.2025.
It is jointly submitted by SPA holder of plaintiff and
Ld. counsel for D-1 and D-2 that the present suit has been
amicably settled between the parties and further requests to pass
a consent decree in the present case.
Heard.
Separate statements of SPA holder of plaintiff and
defendant no.1 recorded in this regard.
Parties are bound by their statements before the
mediation as well as before this court.
Considering the submissions of SPA Holder of
plaintiff and Ld. counsel for D-1 and D-2, mediation settlement
dated 13.05.2025 and statements of plaintiff and D-1, a consent
decree is hereby passed in the present suit in terms of the
settlement dated 13.05.2025 Ex.P-2 agreed between the parties
before mediation and statements of parties recorded today.

As the matter has been settled before the Mediation
Centre, the plaintiff is entitled for refund of the court fees.
Considering the facts of the case, court fees be
refunded to the plaintiff as per rules.
The present suit is accordingly disposed off.
Decree sheet be drawn accordingly.
File be consigned to record room after due
compliance.
