petitioner.
Ld. Counsel for petitioner has filed certified copy of
criminal case. Copy supplied.
Pleadings of the parties are complete on record. On the basis
of pleadings of the parties, following issues are hereby framed as under:
(i) Whether deceased namely Sh. Awdesh Kumar died on
account of injuries sustained in accident having taken place on
07.01.2026 at about 10.15 pm near Railway Station Cut, G.T. Road,
Ghaziabad, U.P. within the jurisdiction of PS Ghaziabad, Kotwali, U.P.
due to rash and negligent driving of driver of vehicle no. UP-16NT- 4359
by respondent no. 1? OPP
(ii) Whether petitioners are entitled to compensation, if so to
what amount and from whom? OPP.
(iii) Relief.
Be put up for PE on 22.10.2026.
Petitioner is hereby directed to furnish advance copy of evidence
by way of affidavit of the proposed witnesses to the respondents atleast
15 days prior to the NDOH either against receipt or by placing the same
on judicial file under intimation to the respondents to be collected by the
parties as per their respective convenience.
