Written statements of respondents are already on
record. Pleadings are complete. On the basis of pleadings,
following issues are framed: -
(i). Whether Baby Aarohi died in a motor vehicular accident occurred on
31.08.2023 at 8.00 p.m. near Gram Patthar Kheda, Rampur, U.P. within
jurisdiction of PS Bhot, due to rash and negligent driving of offending
vehicle i.e. motorcycle bearing registration No.UP-22AU-9154 driven by
respondent no. 1 Sh. Pradeep Kumar (driver)? (OPP).
(ii). Whether the petitioners are entitled to compensation on account of
said accident and if yes, to what extent and from whom? (OPP).
(iii) Relief.
No other issue arises or is pressed for.
List of witnesses be filed by the petitioner, if already
not filed within two weeks from today. Advance copy of
evidence by way of affidavit of petitioner’s witnesses, if already
not filed, be filed as well as be supplied, if already not supplied,
to the respondents at least 7 days before NDOH.

As there are two connected cases bearing MACT
NO.113/24 and 114/24 emanating from the same accident and
common FIR was registered, both the cases are hereby
consolidated for the purpose of recording evidence. The petition
no.113/24 is treated as the main petition, let the evidence
recorded in the main petition be read as
mutatis mutandis in the
connected case bearing MACT No.114/24.
Put up for PE before the Tribunal on 14.01.2026.
