Heard. Perused.
It is revealed on perusal of file that R1 and R2 have not
filed their reply/WS even after the expiry of stipulated period of time as
per law in this regard. Hence, defence of R1 and R2 is hereby struck
off.
Pleadings of the parties are complete on record. On the
basis of pleadings of the parties, following issues are hereby framed as
under:
(i) Whether deceased namely Roop Kishor died on account
of injuries sustained in accident having taken place on 20.08.2024 at
about 01:15 pm at Hariyali Farm House, Mahmoodpur, Ghaziabad,
U.P. within the jurisdiction of PS Tila Mod, Distt. Trans Hindon
(Commissionerate Ghaziabad), U.P. due to rash and negligent driving
of driver of vehicle no. UP14QT-0722 by respondent no. 1 ? OPP
(ii) Whether petitioners are entitled to compensation, if so to
what amount and from whom? OPP.
(iii) Relief.
Be put up for PE on 06.07.2026.
Petitioner is hereby directed to furnish advance copy of evidence
by way of affidavit of the proposed witnesses to the respondents atleast
15 days prior to the NDOH either against receipt or by placing the
same on judicial file under intimation to the respondents to be collected
by the parties as per their respective convenience.
