WS of D-1 and WS of D-2 and D-3 filed on
23.04.2026. Copy already supplied. Same has been
acknowledged.
Ld. counsel for plaintiff, on instructions submits that
plaintiff does not wish to file replication to the written statements
of defendants No.1 and 2 and 3.
Defendants have not filed their affidavit of
admission and denial of documents till date despite directions.
Defendants are also not present.
In view of the circumstances, admission and denial
of documents could not be conducted.
Pleading of the parties are completed. From the
pleadings of the parties, following issues are framed:-
1. Whether plaintiff has paid an amount of Rs.5 lakhs to
defendants as commission, as claimed? OPDs
2. Whether this Court has no subject matter jurisdiction to try
and adjudicate the present suit, as claimed? OPDs
3. If the answer to issue Nos.1 and 2 comes in negative then
whether plaintiff is entitled for money decree for recovery of a
sum of Rs.5 lakhs against defendants, as prayed? OPP

4. Whether plaintiff is entitled for interest on the suit amount?
If yes, then at what rate and for what period? OPP
5. Whether there is no valid cause of action for filing the
present suit against defendant No.2 and 3, as prayed? OPD-2 & 3
6. Relief.
No other issues arises or is pressed by the parties, at
this stage. Parties are directed to file their respective list of
witnesses within 15 days from today.
Plaintiff is directed to file evidence affidavits of all
his witnesses within 45 days, with an advance copy to
defendants, at 15 seven days prior to NDOH.
Put up for PE on 22.10.2026.
