An application under Order VI Rule 17 r/w Section
151 CPC filed on 01.06.2024.
File perused.
Plaintiff by way of amendment wants to amend the
prayer clause of the plaint and wants to withdraw his claim of
Rs.10,620/- and direction to procure 25,000 Kg of ABS Flex
from M/s Top Scene Ltd.
In view of the contentions made in the application,
submissions given by Ld. counsel for the plaintiff, considering
the fact that present suit is still at initial stage, defendant is yet to
be summoned in the present suit and proposed amendment shall
not change the nature of suit, the application under Order VI Rule
17 r/w Section 151 CPC is stand allowed.

CPC is accordingly disposed off.
Amended plaint taken on record.
File perused.
Issue summons in the present suit upon the
defendant through the concerned Ld. Principal District &
