Counsel for the defendant no. 2 has filed hardcopy of an application under Order 11 Rule 1(10) r/w section 151 of CPC to place on record the Resolution of Board along with the photocopy of Power of Attorney and Resolution of board. Copies thereof have been supplied to the Ld. Counsel for the plaintiff. The Ld. Counsel for the defendant no. 1, who has also appeared through VC has also admitted that she has received the copies thereof. Filing thereof on the e-portal has been verified by the Assistant Ahlmad posted in this court, who has also reported that this application has been filed without court fees. On this, Ld. Counsel for the defendant no. 2 has sought permission to affix the court fees thereon. Accordingly, he is allowed to affix the court fees thereon. Accordingly, the Ld. Counsel for the defendant no. 2 has affixed the court fees of Rs 2/- thereon. Soon, thereafter, the Ld. Counsel for the defendant no. 2 has sought permission to withdraw the same, as the defendant no. 2 could not mention about photocopy of Power of Attorney filed along with application. Separate statement of the Ld. Counsel for the defendant no. 2 has been recorded to this effect. Ld. Counsel for the plaintiff has -- 1 of 2 -- submitted that defendant no. 2 is wasting the time of the court and also delaying the case of the plaintiff. However, in view of the request made by the Ld. Counsel for the defendant no. 2, this application is dismissed as withdrawn. The defendant no. 2 will be liberty to file afresh similar application. Matter stands adjourned for filing such application by the defendant no. 2. To come up on 24.08.2026.
