The matter is fixed for hearing arguments on the
application under Order 8 Rule 1A r/w Section 151 of CPC. After part
arguments thereon by the Ld. Counsel for the defendant no. 2, he has
sought to permission to withdraw the said application under Order 8
Rule 1A r/w Section 151 of CPC in view of some clerical mistake
therein with the liberty to file afresh application. Separate statement
of the Ld. Counsel for the defendant no. 2 has been recorded to this
effect. In view of the statement of the Ld. Counsel for the defendant
no. 2 recroded today in the court, the said application under Order 8
Rule 1A r/w Section 151 of CPC is dismissed as withdrawn. The
defendant no. 2 will be at liberty to file afresh similar application to
file the Resolution. The matter stands adjourned for filing of
miscellneous application. To come up on 23.07.2026.
