WS has been e-filed on behalf of the defendants on
04.04.2025 and hard copy has been filed today alongwith
documents. Copy supplied.
Ld. Counsel for plaintiff submits that there is delay in
filing the WS on behalf of the defendants.
In this regard, condonation application has been filed
on behalf of defendants on the ground that both the defendants are
residing in Kolkata and due to this reason, it took some time in
preparation of the WS and filing the supporting documents.
Ld. Counsel for plaintiff submits that he has no
objection if the WS filed on behalf of the defendants be taken on
record subject to costs.
In view of the above and in the interest of justice that
matter may be decided effectively between the parties on merits,
the WS filed on behalf of the defendants is hereby taken on record
subject to costs of Rs.2,000/- to be paid to the plaintiff.
Condonation application filed on behalf of the
defendants stands disposed of.
Put up for payment of costs/ filing of replication on
behalf of plaintiff/ framing of issues on 02.07.2025.
