Fresh Claim petition received by way of assignment. It be checked and
registered.
Present:- Sh. Satendra Singh, Advocate for petitioner with petitioner.
Arguments heard. Record perused.
The accident in the present case had taken place at PS
Kotwali, District Bulandshahar, U.P. However, the petitioner submits that he
is residing at Harsh Vihar, Delhi within the territorial jurisdiction of this
Tribunal. Copies of relevant documents in support of address proof are
placed on record.
Thus, issue notice of the petition to all respondents on filing
of PF/RC for 19.05.2023.
Petitioner is directed to file complete criminal case record on
or before NDOH.
Petitioner are directed to open their saving bank A/c in a
nationalized bank, near the place of their residence.
For the protection of award amount, the concerned bank
Manager is directed as under:-
(i) No cheque book/Debit Card be issued to the
claimant/petitioner without permission of the Court. However, in case the
debit card and/or cheque book have already been issued bank shall cancel
the same before the disbursement of the amount.
(ii) The Bank shall not permit any joint name(s) to be
added in the savings bank account or fixed deposit accounts of the
claimant / petitioner. The Bank Manager is directed to make endorsement
regarding compliance of aforesaid directions on the passbook. The
claimant / petitioner shall produce the passbook with the necessary
endorsement as well as Aadhar Card and Pan Card before the Tribunal on
the next date of hearing.
