An application seeking exemption from personal
appearance of accused Sayed Mohd. Umar has been moved by
the counsel for the accused. For the reasons mentioned in the
application, the application is allowed and the personal
appearance of the accused is exempted for today.
An application under Section 315 CrPC has been
filed on behalf of the accused as he intends to step into the
witness box in his defence. Copy supplied. Heard. The
application is allowed.
DW1 Ms. Saima Umar is present. However, her
cross-examination is deferred at the request of Ld. Addl. PP for
the State. She is bound down for the next date.
It is pointed out by the counsel for the accused that
an application under Section 448 of BNSS seeking joint trial of
State cases arising out of FIRs No. 104/2019 & 725/2019 is
pending. Copy supplied. Ld. Addl. PP for the State states that
assistance of the IO is required. Accordingly, let a report be
called from the IO as to whether both the aforesaid FIRs arise out

of the same incident.
