Present : Ms. Shweta Garg, Ld. Counsel for applicant.
Sh. Ram Kewal, Bailiff from SDM-Seemapuri, is
present and filed report on behalf of the SDM, wherein it is
mentioned that “
the applicant has not applied for refundation of
e-court fee in this office, hence no refund has been initiated in
respect of M/s Ajay Gupta Proprietor of Ajay Enterprises till
date”. The bailiff present in the court has stated that the court fee
is still deposited. He has also made an endorsement to this effect
on the reply itself.
In view of this report, as the court fee is lying
deposited with the SDM office, the court fees be returned to the
plaintiff/applicant as per Section 16 of Court Fees Act, in terms
of the order dated 28.04.2016, passed by Dr. T.R. Naval, the then
Ld. District & Sessions Judge, Shahdara District, KKD Courts,
Delhi. E-court fees be returned and a certificate be issued as per
rules. The application is allowed.
Miscellaneous file be consigned to record room.
